In short: These terms follow Indian law; disputes go through informal resolution first, then arbitration if needed.
Governing Law
These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act 1872, the Information Technology Act 2000, and the Consumer Protection Act 2019.
Jurisdiction
Subject to the dispute resolution process below, you agree that any legal action or proceeding arising out of or relating to these terms or your use of CareerARIA shall be brought exclusively in the courts of competent jurisdiction in India, and you consent to the personal jurisdiction of those courts.
International Users, Including Users in the United States
CareerARIA is offered to job seekers in India and the United States. Regardless of where you access the service from, your relationship with us is governed contractually by the choice of Indian law and Indian courts set out above, and all data you submit is processed and stored in India as described in our Privacy Policy.
This choice of law is a contractual arrangement between you and us. It does not remove or override any consumer-protection, data-privacy, or other right that is granted to you by mandatory law in your own country or state and that cannot be waived by contract under that law. If any such mandatory right applies to you, it continues to apply alongside these terms; nothing in this policy is intended to, or does, strip you of it.
We do not currently operate at a scale that triggers comprehensive US state privacy statutes such as the California Consumer Privacy Act (CCPA/CPRA), and we do not make any representation of compliance with, or rights granted under, such statutes unless we notify you otherwise. If our user base or revenue grows to a point where such a law applies to us, we will update this policy and our practices accordingly, and notify affected users.
CareerARIA is not currently offered to users in Canada, the United Kingdom, or Australia. When we launch in any of these countries, we will update our Privacy Policy and these Terms to reflect the applicable local law in each case — for example PIPEDA in Canada, the UK GDPR and Data Protection Act 2018 in the United Kingdom, and the Privacy Act 1988 in Australia — before the service becomes available to users there.
If you reside outside India and are unsure how local law interacts with these terms, we recommend seeking independent legal advice; nothing here is a substitute for that advice.
Dispute Resolution
Before initiating any legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at support@careeraria.com. We will attempt in good faith to resolve the dispute within 30 days.
If the dispute is not resolved informally, either party may refer it to arbitration in accordance with the Arbitration and Conciliation Act 1996. The arbitration shall be conducted in English, in India. The arbitral award shall be final and binding on both parties.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
